Welcome to Kuure Health Limited! The following terms and conditions govern your use of our website, www.KuureHealth.com, and the purchase of any products (“Products”) listed on the site. By ordering Products from our site, you agree to be bound by these terms and conditions. Please read them carefully, and feel free to print a copy for future reference. If you agree, click the ‘I Accept’ button. Note that if you do not accept these terms, you will not be able to order any Products from our site.

2. Service Availability

Our services and Products are available only to customers in the United Kingdom and Northern Ireland.

3. Your Status

By placing an order on our site, you confirm that:
3.1.1 You are legally capable of entering into binding contracts.
3.1.2 You are at least 18 years old.

4. How the Contract is Formed

4.1 After you place an order, you will receive an email acknowledging receipt. This does not mean that your order has been accepted. Acceptance is confirmed only when you receive a dispatch confirmation email. At that point, a binding contract (“Contract”) is formed between us.

4.2 The Contract applies only to Products listed in the dispatch confirmation. Products not listed will not be included in the Contract until confirmed in a separate dispatch confirmation.

5. Consumer Rights

5.1 If you are purchasing as a consumer, you have the right to cancel your Contract within fourteen working days of receiving the Products. You will receive a full refund as per our refund policy outlined in Section 10.

5.2 To cancel a Contract, notify us in writing and return the Products in the condition you received them, at your own cost and risk. You are required by law to take reasonable care of the Products while they are in your possession.

5.3 Details of your statutory rights and instructions on how to exercise them will be provided in the dispatch confirmation email.

6. Availability and Delivery

6.1 We will deliver your order by the date specified in the dispatch confirmation or within 30 days if no date is specified, unless exceptional circumstances arise.

7. Risk and Title

7.1 The risk of loss or damage to the Products passes to you upon delivery.
7.2 Ownership of the Products transfers to you only when we have received full payment, including delivery charges.

8. Price and Payment

8.1 Prices for Products are as quoted on our site, inclusive of VAT but excluding delivery costs.

8.2 Prices are subject to change but will not affect orders for which a dispatch confirmation has been sent.

8.3 In the event of a pricing error, we will verify prices as part of our dispatch procedures. If the correct price is lower, we will charge the lower amount. If the correct price is higher, we will either contact you for instructions before dispatching or reject your order and notify you.

8.4 We are not obligated to supply the Product at the incorrect lower price if the error is obvious and could have reasonably been identified by you.

8.5 Payment must be made by credit or debit card. We accept Visa, Mastercard, American Express, and Maestro. Your card will not be charged until the order is dispatched.

9. Shipping Charges

9.1 Shipping charges vary based on the weight of the Product and the destination. These charges are displayed during the checkout process.

10. Refunds Policy

10.1 If you return a Product:
10.1.1 Because you have cancelled the Contract within the fourteen-day cooling-off period, we will process the refund, including the original shipping cost, within 30 days of receiving your cancellation notice.
10.1.2 For other reasons, we will inspect the returned Product and notify you of your refund eligibility. Refunds for defective Products will include both the delivery charges and your return costs. Refunds will not incur restocking or administration charges.

10.2 Refunds will be processed using the same payment method you used for the original purchase.

11. Our Liability

11.1 We warrant that the Products purchased through our site are of satisfactory quality and fit for purpose.

11.2 Our liability for losses you suffer due to breach of contract is limited to the purchase price of the Product.

11.3 We do not exclude or limit liability for:
11.3.1 Death or personal injury caused by our negligence.
11.3.2 Fraud or fraudulent misrepresentation.
11.3.3 Any matter for which it would be illegal to exclude or attempt to exclude liability.

11.4 We are not liable for indirect losses, including but not limited to:
11.4.1 Loss of income or revenue.
11.4.2 Loss of business or profits.
11.4.3 Loss of anticipated savings or data.
11.4.4 Waste of management or office time.

12. Written Communications

12.1 By using our site, you agree that communication with us will primarily be electronic (e.g., email or website notices). For contractual purposes, you consent to receive communications electronically and acknowledge that these comply with any legal requirements for written communication.

14. Transfer of Rights and Obligations

14.1 The Contract is binding on both parties and their successors.
14.2 You may not transfer or assign the Contract without our prior written consent.
14.3 We may transfer, assign, or subcontract the Contract at any time.

15. Events Outside Our Control

15.1 We are not liable for any delay or failure to perform our obligations due to events outside our reasonable control (“Force Majeure Event”).

15.2 Force Majeure Events include but are not limited to:

  • Industrial action, civil unrest, war, natural disasters, transportation or telecommunication disruptions, or government actions.

15.3 Our obligations are suspended during the Force Majeure Event, and we will take reasonable steps to resolve it or find alternative ways to fulfill our obligations.

16. Waiver

16.1 If we do not enforce a right under the Contract, it does not constitute a waiver.
16.2 A waiver of any default does not constitute a waiver of subsequent defaults.
16.3 No waiver is effective unless communicated in writing as per Section 13.1.
